Cartel conduct in relation to public tenders is criminalised under Law 1340 of 2009. Other cartel conduct is not criminalised.
The offence
It is a criminal offence to enter into an agreement whose purpose or effect could be colluding in public tenders or contests, distributing awarded contracts, or fixing the terms of proposals.
Sanctions
Individuals
A minimum of six and a maximum of twelve years’ imprisonment and a prohibition on participating in public biddings or executing contracts with public bodies for eight years.
Corporations
Cartel conduct is not criminalised.
